Illegal Workers Policy

Introduction 

Conway Cladding Ltd is committed to complying with all UK immigration laws and ensuring that all individuals working on our sites are legally entitled to work in the United Kingdom. This policy outlines the company’s requirements for verifying the right to work and the responsibilities of subcontractors and employees in ensuring compliance with UK employment law. 

Scope 

This policy applies to all employees, subcontractors, and any third parties providing services to Conway Cladding Ltd. It outlines the documentation required to verify the right to work in the UK and the steps Conway Cladding Ltd will take to prevent illegal working practices. 

Legal Requirements 

In accordance with the Immigration, Asylum and Nationality Act 2006, it is illegal to employ or engage the services of any person who does not have the legal right to work in the UK. Conway Cladding Ltd will not tolerate any breach of this requirement and is committed to ensuring that all workers and subcontractors are legally compliant. 

Proof of Right to Work 

Before commencing work on any project, all subcontractors must provide Conway Cladding Ltd with valid proof of their right to work in the UK. Acceptable forms of documentation include: 

  • UK Birth Certificate 
    or 
  • UK Passport 
    or 
  • Proof of Right to Work in the UK (e.g., a valid Biometric Residence Permit, Settlement Status, or a Home Office-issued Certificate of Application). 

 

Subcontractor Responsibilities 

Subcontractors must: 

  • Provide one of the acceptable forms of documentation listed above before commencing work on any Conway Cladding Ltd project. 
  • Ensure that any employees or workers they engage on behalf of Conway Cladding Ltd are legally entitled to work in the UK. 
  • Keep records of right-to-work checks for all workers in line with UK law and provide Conway Cladding Ltd with these records upon request. 

Failure to provide valid proof of right to work will result in immediate suspension of work and possible termination of any contractual relationship with Conway Cladding Ltd. 

Company Responsibilities 

Conway Cladding Ltd will: 

  • Verify the authenticity of all right-to-work documents provided by subcontractors and workers before they commence work. 
  • Maintain records of right-to-work checks for auditing and compliance purposes. 
  • Conduct regular audits to ensure that all subcontractors and workers continue to comply with the UK’s right-to-work requirements throughout the duration of their engagement. 

Consequences of Non-Compliance 

Subcontractors or workers who fail to provide proof of their right to work in the UK or who are found to be working illegally will face immediate action, which may include: 

  • Termination of their contract or engagement with Conway Cladding Ltd. 
  • Reporting to the relevant authorities, including the Home Office, in cases of suspected illegal working. 
  • Legal action if necessary, in accordance with UK law. 

Conway Cladding Ltd reserves the right to withhold payment for services rendered by any subcontractor who fails to comply with this policy. 

Monitoring and Review 

Conway Cladding Ltd will regularly review this policy to ensure ongoing compliance with UK immigration laws and best practices. Any changes to legislation or company procedures will be reflected in updates to this policy.
